Affiliate Terms

1. Agreement Overview

These Affiliate Terms ("Terms") form a binding agreement between you ("Affiliate") and PikaSim ("Company") governing your participation in the PikaSim Affiliate Program. By submitting an affiliate application you agree to be bound by these Terms, our Terms of Service, and our Privacy Policy. Your acceptance, including the date and time, is recorded when you apply.

2. Application and Approval

• Approval is required and discretionary. Submitting an application does not create an affiliate relationship. We review every application by hand and may decline any application without giving a reason.
• Accurate information. You must provide a working email address and the genuine website or channel on which you will promote us. Misrepresenting who you are, what you operate, or your relationship to a third party site is grounds for immediate termination and forfeiture of unpaid commission.
• Your referral code is issued by us. You may request a preferred code, but the code we issue is the only one that attributes to you. Using a code that has not been issued to you creates no entitlement to commission.
• No exclusivity. Approval does not grant exclusivity in any territory, market, or channel.

3. Commission and Attribution

• Rate. 10% of gross USD on attributed, provisioned sales, on both card and cryptocurrency checkout.
• Attribution. A sale is attributed to you when a visitor arrives through your referral link and completes a purchase within the attribution window. Attribution is first touch with a 30 day window, recorded in a first-party cookie. If a discount code has been issued to you, a sale on which that code is typed also attributes to you. A sale attributed both ways is counted once.
• Provisioned sales only. Commission accrues on sales that are paid and provisioned. Sales that are refunded, cancelled, charged back, or never provisioned do not accrue commission, and commission already credited on such a sale may be reversed.
• Our records govern. Commission is calculated from our own attribution records. Where your figures and ours differ, ours govern, and we will explain the difference on request.
• Rate changes. We may change the commission rate with reasonable notice. A change never applies retroactively to sales already attributed.

4. Payment

• Monthly statement. On the 1st of each month we email you a statement for the previous calendar month listing each attributed sale, the gross amount, your commission, and your lifetime total.
• Invoice based. You invoice us against your statement. There is no minimum payout, no deadline, and any unpaid balance rolls over. We do not prepay commission.
• Payment method. We agree a payment method with you at your first invoice. We do not pay commission in a form we cannot verify.
• Verification. We verify invoiced amounts against our records before paying, and may hold payment while we investigate a discrepancy or suspected breach of section 5.
• Taxes. You are responsible for any taxes arising on commission you receive, and for your own compliance in your jurisdiction.

5. Promotional Conduct

The following are prohibited. Each is grounds for immediate termination and forfeiture of unpaid commission, and we may reclaim commission already paid on affected sales.

• Self referral. You may not use your own referral link or code for your own purchases, or for purchases by anyone acting on your behalf or at your direction. Commission is for traffic you introduce, not for discounting your own orders.
• Cookie stuffing and forced clicks. Setting attribution without a genuine, intentional click by the visitor, including hidden iframes, automatic redirects, pop unders, and scripted or automated traffic.
• Paid brand bidding. Bidding on "PikaSim" or confusingly similar terms in paid search or paid social, or using them in display URLs, without our prior written permission.
• Impersonation and typosquatting. Registering or operating domains, accounts, or profiles that imitate PikaSim or imply you are us, an official partner, or our support channel.
• Misrepresentation. Stating prices, coverage, speeds, refund rights, or legal characteristics that we do not ourselves state. In particular, you must not present our privacy features as a means of evading sanctions, law enforcement, or any legal obligation.
• Unsolicited messaging. Promoting us through spam email, unsolicited direct messages, or any channel that breaches applicable marketing law.
• Unsuitable placement. Promoting us alongside content that is illegal, sexually explicit, hateful, or that targets children.
• Incentivised traffic. Offering cashback, rewards, or other inducements in exchange for clicks or purchases through your link, without our prior written permission.

6. Use of Our Brand

• We grant you a limited, non exclusive, revocable licence to use the PikaSim name and logo solely to link to and describe our products while these Terms are in force.
• You must not alter our logo, use it as your own, or use it in a way suggesting you are PikaSim or speak for us.
• You are responsible for the accuracy of everything you publish about us. We may ask you to correct or remove a specific claim, and you must do so promptly.
• The licence ends when your participation ends, and you must then stop using our brand and remove your referral links.

7. Customer Relationship and Privacy

• Customers are ours. A visitor who purchases through your link is our customer. You do not acquire any right in them.
• No data collection on our behalf. PikaSim does not require accounts and does not collect customer email addresses. You must not collect personal information from visitors while representing that PikaSim requires it, and you must not present yourself as our support channel.
• Support. Direct any customer question to our support. You must not answer support questions on our behalf.
• Your dashboard link is a secret. The URL of your earnings dashboard grants access to your earnings data. Keep it confidential. Tell us if it is exposed and we will issue a replacement.

8. Suspension and Termination

• Either party may end participation at any time, for any reason, on written notice.
• We may suspend attribution or withhold payment while investigating a suspected breach of section 5, or a pattern of sales inconsistent with genuine referred traffic.
• On termination without breach, commission properly accrued up to the termination date remains payable on the normal invoice terms.
• On termination for breach of section 5, unpaid commission on affected sales is forfeited.
• You must remove your referral links promptly on termination. We are not liable for commission on traffic sent after participation ends.

9. Independent Parties

You are an independent contractor. Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency. You have no authority to make any commitment on our behalf, and you must not represent that you can.

10. Disclaimer and Liability

• We make no representation about the earnings you may achieve. Any figures we publish are illustrative, not a forecast.
• The program is provided as is. We do not warrant uninterrupted availability of our site, checkout, or attribution system.
• To the extent permitted by law, our total liability under these Terms is limited to the commission properly accrued and unpaid to you at the time the claim arises.

11. Changes to These Terms

We may update these Terms. Material changes take effect on the date published on this page, and continuing to promote us after that date is acceptance. A change never applies retroactively to commission already accrued.
